Terms of engagement summary
Last updated 1 November 2026
1. Who we are
MSurveying is a trading name of Mytoor Ltd, registered in England and Wales (company no. 11034271), registered office 4 Station Parade, Ruislip, HA4 7DL. We are regulated by RICS (firm registration no. 894570). Our work is carried out or reviewed and signed by Hardeep Toor MRICS MCIOB. We work in accordance with the RICS Rules of Conduct and, for cost estimates and cost plans, the RICS Cost prediction professional standard.
2. Scope and fees
- Each service has a defined scope, fixed fee and turnaround, confirmed in writing before we start.
- Work outside the agreed scope (for example a changed layout, a new price or further meetings) is agreed and priced before we do it.
- Our fees are fixed. They never depend on the conclusions of a report or on whether you buy or proceed.
- Prices on our website exclude VAT, which is charged at the applicable rate.
- Payment terms are set out in your terms of engagement.
3. What our reports are and are not
- Our reports are development appraisals and cost advice to support your decision. The decision to bid, exchange or proceed is yours.
- They are not RICS Red Book valuations. A maximum bid is a residual figure based on stated assumptions, not an opinion of market value. You should obtain a Red Book valuation before exchange, and any lender will rely on its own valuer.
- Class MA checks are a preliminary desktop screening against the Class MA conditions and public records. They are not a planning opinion, a lawful development certificate or a guarantee of prior approval, which is decided by the local planning authority. We do not act as planning consultants.
- Cost plans are estimates at the stated base date and design stage. They are not tender prices, quotations or fixed prices.
- Finance figures are illustrative and are not financial advice. We are not authorised to give regulated financial advice.
- We do not give legal or tax advice. Comments on title or documents identify commercial risks only and must be confirmed by your solicitor. SDLT and VAT should be confirmed by your accountant.
- We do not check the adequacy of design, Building Regulations compliance or fire safety design. These remain with your design team and building control body.
- Unless agreed in writing, we do not carry out building surveys, measured surveys or tests of services, structure, asbestos or contamination.
4. Information we rely on
We rely on information provided by you, agents and third parties, and do not verify it unless we say so. We are not responsible for errors caused by information that was incomplete, inaccurate or withheld. Floor areas are taken from the sources stated in the report.
5. How long a report stays current
Reports speak at their date of issue. Costs, values and finance terms can change quickly. If you make a decision more than 3 months after issue, or the price, layout or market changes, the figures should be refreshed. A re-run is available for a fixed fee.
6. Reliance and confidentiality
- Reports are for the named client and the stated purpose only. No one else, including a lender, investor, partner or later buyer, may rely on a report unless we issue them a written reliance letter. Reliance letters are available on request, may carry a fee and carry the same limitations as the report.
- You may share a report with your professional advisers and prospective lenders for information only.
- Reports are confidential and must not be published without our written consent. We keep the copyright in our reports and appraisal models. You may use them for the scheme they were prepared for.
7. Our liability
Our liability is limited as set out in your terms of engagement. In summary, it is capped at the amount stated there, it is limited to our fair share of any loss, and it excludes loss of profit and indirect or consequential loss. Nothing limits liability that cannot legally be limited, such as liability for death or personal injury caused by negligence, or for fraud.
8. Conflicts of interest and referrals
- We check for conflicts of interest before accepting an instruction, and tell you if anything needs your consent.
- While we act for you on a scheme, we will not act as monitoring surveyor for a lender on the same scheme.
- Any referral arrangement, fee or benefit relating to your instruction is disclosed to you in writing before you instruct us.
9. Insurance
We hold professional indemnity insurance in line with RICS requirements. Details are available on request.
10. If you're a consumer
If you instruct us as an individual acting outside your trade or business, and you agree the instruction at a distance (for example online or by email), you have the right to cancel within 14 days of the agreement without giving a reason. If you ask us to start work within the 14 days, you will pay for the work done up to the date you cancel. If the work is fully completed within the 14 days at your request, the right to cancel is lost once it is complete. To cancel, email hello@msurveying.co.uk. These rights do not apply to business clients.
11. Complaints
If you're unhappy with our service, please see our Complaints procedure.
12. Your data
We handle personal data in line with UK GDPR and our Privacy notice.
13. Law
These terms, and any dispute arising from them, are governed by the law of England and Wales and subject to the jurisdiction of its courts.
